Failure to Register
When an individual is convicted of committing a sex crime, he or she is required by law to register as a sex offender with the Florida Department of Law Enforcement (FLDE). The sex offender registration system was designed and implemented to help monitor and keep track of known convicted sex offenders. As soon as a convicted sex offender registers his/her information with the FLDE, his/her photo and information will be available on the FLDE website for public viewing.
Convicted sex offenders must adhere to the following requirements:
- Must maintain a current Florida state driver’s license or identification card at all times
- Must provide the FLDE with the following information: name, age, sex, height, weight, eye color, hair color, race, address, date of birth, any identifiable marks or tattoos, date of conviction, description of crime, fingerprints, digital photograph, social security number, date and place of employment, genetic markers
- Must report in person to the Department of Highway Safety and Motor Vehicles (DHSMV) within 48 hours every time you establish new or temporary residency
- Must re-register with the DHSMV in person every year, or when renewing a driver’s license or Florida identification card
Failure to register as a sex offender with the FLDE is a 3rd degree felony offense that will result in additional criminal charges and penalties, such as prison, steep fines, and extended probation. Sex offenders are required to register for life unless they have been acquitted of their conviction, received a full pardon, or have had their civil right restored. After ten years, if a convicted offender has had no additional arrests, he/she has the opportunity to petition for a removal of his/her predatory designation.
